Terms & Conditions 

1. Acceptance of Terms

By requesting a quote, approving works, issuing a work order, or engaging Magnus All Property Services (“Magnus”, “we”, “us”, or “our”), the client agrees to these Terms & Conditions.
Approval may be given verbally, by email, by work order, or by allowing works to commence.

2. Quotes & Scope of Work

  • All quotes are valid for 30 days unless otherwise stated.

  • Quotes are based on visible site conditions and information provided at the time.

  • If site conditions differ, Magnus reserves the right to vary pricing or scope.

  • Any additional work requested outside the original scope will be charged accordingly.

3. Site Access & Client Responsibilities

The client is responsible for ensuring:

  • Safe and reasonable access to the property at the scheduled time

  • Pets are secured and not present in work areas

  • Vehicles, personal items, and obstacles are removed

  • Tenants, neighbours, or property managers are notified where required

If access is not available, Magnus may charge a call-out fee or rescheduling fee.

4. Underground Services & Hidden Hazards

Magnus is not responsible for damage to:

  • Irrigation systems

  • Cables or pipes

  • Septic systems

  • Edging, paving, or structures

that are not visible, marked, or disclosed prior to works.
Clients must inform Magnus of any known hazards before work begins.

5. Weather & Scheduling

Outdoor work is subject to weather conditions.

Magnus may:

  • Delay works due to rain or unsafe conditions

  • Reschedule jobs as required

  • Adjust timelines without penalty

We will always attempt to notify clients as early as possible.

6. Lawn, Garden & Plant Outcomes

While Magnus uses professional methods and care:

  • We cannot guarantee plant survival, turf establishment, or weed suppression due to environmental conditions, soil quality, watering practices, or ongoing maintenance.

  • Clients are responsible for after-care unless otherwise agreed.

7. Damage & Pre-Existing Conditions

Magnus will take reasonable care while performing works.
However, we are not liable for:

  • Failure of old or brittle fences, edging, or structures during vegetation removal

  • Damage caused by pre-existing structural weaknesses

  • Surface cracking or movement due to heavy machinery where access is approved

8. Payment Terms

Unless otherwise agreed in writing:

  • Residential invoices are due within 7 days

  • Commercial / strata invoices are due within agreed contract terms

  • Magnus reserves the right to charge interest or late fees on overdue accounts

  • Magnus may suspend future works until overdue invoices are paid

Ownership of supplied materials remains with Magnus until paid in full.

9. Cancellations & Changes

  • Cancellations within 24 hours of scheduled works may incur a fee

  • Magnus reserves the right to reschedule works if required

  • Clients requesting changes after approval may incur variation charges

10. Photographs & Marketing

Magnus may take photographs of works completed for:

  • quality assurance

  • records

  • marketing and promotional use

No personal identifying details will be published without consent.

11. Liability Limitation

To the extent permitted by Australian Consumer Law, Magnus’ liability is limited to:

  • re-performing the services, or

  • refunding the value of the services provided.
